Terms of service

1. Object and parties 

The current conditions of sale apply to the purchase of all products for sale by the Vendor, namely posters, lithographs, decorative items etc.  The current terms and conditions govern the contractual relation between the company MEDEIS and its customer, in a personal or professional capacity, both parties having understood and accepted them unreservedly.
The terms and conditions prevail over any other conditions in any other document, except with prior written or special consent.  They are modifiable at any time without notice.

All orders of a specific quality from the company MEDEIS are intended for the personal use of the customer.  In this case, the customer or the recipient of the goods, is forbidden to sell on any part of or any of the goods.

2. Products

All the products proposed by MEDEIS are available in principle.
In case of the proven non-availability of an item, or if the customer refuses the order owing to delay which imposes its non-availability, MEDEIS cannot in any way be made responsible.
The images illustrating the products are there for information only and have no place contractually.  If any errors are introduced into the images or pricing, MEDEIS will not become involved.

3. Order

When ordering on the Internet, the automatic registration systems are considered proof of the type, content and date of the order.  The company MEDEIS confirms the  acceptance of an order from the customer’s e-mail address which will be used for correspondence.  The sale will only be completed with confirmation of the order.

In other cases the receipt will be proof of the type, content and date of the order.
In every case the vendor reserves the right to cancel a customer’s order, in which there is a dispute over payment from a previous order.
The information given by the customer, at the time of ordering binds the customer:
If an error is made in the personal details of the recipient, the vendor will not be held responsible for the non-delivery of the product.

Orders will only be accepted from customers whose delivery address is in one of the countries listed below.  In other cases a measure of control stops an order before payment is made.

4. Price

Prices are in Euros.
The price shown on the form does not include shipment, whose value has been established according to clauses in article 6 of the current terms and conditions.
The price indicated at the confirmation of an order, in the case of a sale on the Internet, or in another case, in the invoice, is the final price including all taxes.
The price includes the price of the product, handling charge, care and packing, shipping costs and VAT.  Corporations situated outside French jurisdiction, but within the EU, should declare their VAT numbers.

5. Payment

The price invoiced to the customer is the price shown on the order confirmation or the invoice sent by the vendor.

For individuals and corporations the price of products is due on the day an order becomes effective.

Payment is made securely, in the case of the Internet as well as by cheques issued in Euros in France. When paying by banker’s cheque and after confirmation of the order (and receipt of confirmation by e-mail) send your cheque to MEDEIS  BP  75 7833  OZOIR-LA-FERRIERE CEDEX FRANCE.
An order confirmed by the customer will not be effective until payment has been processed.
If payment has been declined, the order will automatically be cancelled and the customer will be advised in the appropriate way.

6. Shipping

After confirmation of an order MEDEIS is committed to deliver the ordered goods intact, if they are in stock, within a reasonable period to the customer.   
In the case of a transport in system known as of against-refunding at the time of confirmation of the order, the customer will pay in total the amount indicated at the time of confirmation of the order.

Goods will be shipped by registered mail, by Colissimo recorded delivery, or by Colissimo international recorded delivery according to the type and size of shipment, in France and in countries to which MEDEIS agrees to ship its products.

In the case of delays the customer will have no right to claim for damages and interest. In the case of any apparent damage, the customer reserves the right to return  goods as stated in article 8 of the present terms and conditions.
   
In the case of a force majeure like war, rioting, fire, strikes, accidents and the vendor not being supplied, the vendor is exonerated from any obligation to deliver.  The merchandise will be sent at the risk and peril of the customer.  Always check your parcel on delivery.  The customer has a period of 48 hours to make any complaints to the shipper in case of default or damage.

For reasons of availability, a multiple order may be split into more that one delivery to the customer.  The customer will only pay for one shipment.  If the customer wants to deliver to two addresses, it will be considered as two orders, with separate delivery charges.

7. Transfer of property and transfer of risks

MEDEIS holds the products ordered until payment has been activated for the correct amount and has the right to withhold the products if these have not been paid for on the due date.
The transfer of property of the products for the benefit of the purchaser will not take place until the purchaser has paid in full, and the date of delivery of the said products has been set.
On the other hand, the transfer of risks of loss and damage to the goods will be made from the time of delivery of the said products to the purchaser becoming responsible for them..

8. Retraction

The purchaser has 7 days from receipt of the goods to request an exchange or a refund for any items that have not met with his satisfaction.
The items must then be returned in their original condition, with packaging, and all the relevant documentation, to the vendor.
Return shipment charges, in the case of retraction, are the responsibility of the purchaser.

9. Responsibility

The vendor cannot be held responsible for damages of any kind, material, immaterial or physical, which would result in the malfunction or misuse of the commercial products.
It is the same for any potential changes to products as a result of manufacture.
The responsibility of the vendor will in any case be limited to the total of the order, and will not be called into question because of simple flaws or omissions that remain despite precautions taken in the presentation of the products.
In every hypothesis the customer is assured of a legal guarantee of the removal of items with hidden faults, which the purchaser can prove, and acts with minimum delay.

10. Enforceable law

The present contract is subject to French law.  In the case of litigation only civil and commercial jurisdiction will come under the competence of the Court of Appeal in Paris.

11. Legal information

The information on details collected at the end of a sale on the Internet is binding; these details are required for the delivery of orders, issue of invoices and contracts of guarantee.  Default of information will result in the invalidation of the order.  Conforming with the law  “Informatique et des Libertes”, the treatment of personal information relative to customers is made the subject of a declaration according to the Commission Nationale de l’Informatique et des Libertes (CNIL).  The customer has (article 34 of law of 6 January 1978)  the right of access, to modify, rectify and withold any personal information, which can be used by MEDEIS.  Furthermore, the company MEDEIS pledges not to communicate, freely or to benefit from, any personal information of its customers to a third party.

The customer recognises that from the time of placing an order, the current terms and conditions apply and that they are accepted unreservedly.
